1. Introduction
Operaio GmbH (hereinafter referred to as “Operaio,” “we,” or “us”) assures you that it will treat the data you provide with care and responsibility at all times, in compliance with the relevant data protection regulations and on the basis of this privacy policy.
Below you will find information on how we process your personal data when you use our services, visit our websites, communicate with us, or otherwise interact with us. This privacy policy applies to both the website “www.operaio.ch” and “www.operaiosoftware.com.”

3. Personal Data
“Personal data” or “personal information” refers to any information relating to an identified or identifiable natural person (hereinafter “data subject”); a “data subject” is a natural person whose personal data is being processed; “Processing” means any handling of personal data, such as assigning it to an identifier such as a name, an identification number, or location data.
This includes various categories of data, such as name, contact details, email, IP address, or contract data. Statistical data or anonymized data that cannot be directly linked to your person is not included.
We receive this data primarily from you as the data subject yourself and not from third parties. If you disclose data about other persons to us, we assume that you are authorized to do so and that this data is correct, and that you have ensured that these persons have been informed of this disclosure and have consented to it, where necessary.
4. Basis and purposes of data processing
We process your personal data primarily for the purpose of entering into or executing contracts with you and any third parties involved. We also process your personal data to fulfill our legal obligations and/or based on your consent (e.g., contact form).
In addition, we process your personal data and that of other persons, insofar as this is permissible and appears appropriate to us, for the following purposes, in which we have a corresponding legitimate interest:
- For marketing purposes and to maintain relationships, as well as to improve our services and our operations (including the organization of events), provided you have not objected to the use of your data.
- We only evaluate the IP address in the event of attacks on the website's network infrastructure and for statistical purposes; however, it is possible that the service providers commissioned by us, including the tools they use on our website, may process your IP address (see in particular section 11 ff. below).
- Ensuring our operations, in particular IT and our website.
5. Contact form
We offer you the opportunity to contact us using the form provided on our website, for example if you have any questions about our services or products or would like a non-binding consultation. In order for us to deal with your request, we need you to provide your contact details, such as your name, address, telephone number, email address, and your request.
The data you enter is always transmitted in encrypted form (https), as it is generated and transmitted directly from an installed form component within the website. The data transmitted to us when you contact us will be processed exclusively for the purpose of processing your inquiry, clarifying technical problems, and ensuring information security. Otherwise, the data you enter will not be evaluated in any other way or linked to other data.
6. Newsletter
You can subscribe to our newsletter. If you do so and agree to receive the newsletter, you consent to the use of your email address for this purpose. We use a tool called Mailchimp in connection with the newsletter. This external newsletter service provider may collect data (see https://www.intuit.com/privacy/statement/). You can unsubscribe from the newsletter at any time.
The emails may be sent with graphics that enable individual tracking (such as delivery, open, and click rates) or contain links that allow personal analysis. Such analyses are used for quality assurance of the newsletter and to better respond to the interests of our readers.
7. Support
We offer you the option of opening a support ticket with us without an account in order to discuss your request with us. The data you provide (name, address, telephone number, email) will be processed by us for the purpose of handling the support ticket and will not be passed on to third parties.
8. Make an online appointment
We offer you the option of making an appointment with us online to discuss your concerns. The data you provide (name, address, telephone number, email) will be processed by us for the purpose of handling the online appointment and will not be passed on to third parties.
In connection with booking the online appointment, we use a tool from an external service provider, namely Microsoft Booking. It is contractually ensured that this provider does not process your personal data for its own purposes.
9. Application
We publish job advertisements on an irregular basis (e.g. on our website, on relevant portals, etc.). You have the option of sending us your application either by post or electronically, for example via our website. In the case of these (digital) applications and also in the case of unsolicited applications, your applicant and application data will be stored and processed by us (electronically) for the purpose of handling the application process.
If an employment contract is concluded after the application process, we store the data submitted in the application in your personnel file for the purpose of the usual organizational and administrative process—in compliance with further legal obligations.
If an application is rejected, we delete the data submitted to us immediately after notifying you of our negative decision. In exceptional cases, the data will not be deleted if it must be stored for a longer period of time due to legal requirements.
If you expressly consent to the longer storage of your data, e.g., for inclusion in our applicant database, the data will be further processed on the basis of your consent. You can revoke your consent at any time by notifying us with effect for the future. A corresponding notification to the office named in section 2 is sufficient for this purpose. However, the processing operations carried out up to this point are not affected by your revocation.
10. Data disclosure and data transfer abroad
Within the scope of the aforementioned processing purposes (section 4), it may be necessary for us to disclose your personal data to the recipients listed below. These recipients process your data either on our behalf, jointly with us, or on their own responsibility. Where we are obliged to do so, we ensure that the recipients treat your data confidentially and in accordance with the applicable legal provisions and that your data is only used for the purpose of the respective service.
- Your personal data may be transferred to the providers of the tools listed in section 11 below. For further information, please refer to section 11.
- External service providers, including contract processors: IT service providers, cloud and hosting service providers;
- Domestic and foreign authorities, government agencies, and courts, in particular if we are legally obliged to do so;
The recipients may be located both domestically and abroad, which means that your data may also be processed outside Switzerland, in particular in the USA.
If the recipient is located in a country without adequate legal data protection, we contractually ensure that they comply with the applicable data protection regulations, unless they are already subject to a legally recognized set of rules for ensuring data protection and we cannot rely on an exception. Such an exception may apply if you have consented to the transfer or if the data is generally accessible and you have not objected to its processing. Transfer is also permitted in the case of legal proceedings abroad, in cases of overriding public interest, or if the execution of a contract requires such disclosure.
11. Cookies / tracking and other technologies in connection with the use of our website
When you use our website, data is collected and stored in logs (in particular technical data). We also use cookies and similar technologies to identify your browser or device. A cookie is a small text file that is transferred to your computer and stored by your browser when you visit our website.
We use different types of cookies on our website: so-called session-related temporary cookies (so-called session cookies), which are technically necessary for the operation of the website. However, they do not remain on your computer. When you leave our website, the temporary cookie is also deleted. We also use permanent cookies. These remain stored on your computer and allow us to recognize your browser the next time you visit. We also use service providers who may also place cookies on your device on our behalf (so-called third-party cookies). These cookies help us to tailor our site to the specific needs of our visitors. The technical data we collect and the cookies we use do not usually contain any personal data. However, it is possible that the third-party providers we commission may store your personal data, collect information about you using the technical data and/or cookies, and then possibly link this to your person.
We use our own tools and third-party services, which in turn may use cookies on our website, in particular to improve the functionality or content of our website, to compile statistics, and to place advertisements. We currently use the services of the following service providers and advertising partners in particular.
As part of our consent banner on our website, you have the option to adjust the use of cookies accordingly (except for session-related, temporary cookies). However, we would like to point out that in this case you may not be able to use all functions of our website to their full extent.
11.1. Borlabs Cookie
Borlabs Cookie is a special cookie notification plugin for WordPress. The WordPress cookie plugin from Borlabs allows your visitors to select which cookies they want to consent to (opt-in) via a checkbox or switch button for each cookie and cookie group.
11.2. Google Site Kit
Site Kit is a WordPress plugin developed by Google that provides various tools and information from Google on a website. It offers website owners useful features to optimize their website and improve performance. Some of the uses of Site Kit are:
Website analysis: Site Kit displays the most important metrics from Google Analytics directly in the WordPress dashboard. This allows website owners to keep track of their website's visitor numbers, dwell time, bounce rate, and other important statistics.
Search engine optimization (SEO): Site Kit makes it easy for website owners to gain insights into their website's performance in search engines. It displays key SEO metrics from Google Search Console, such as keywords, impressions, clicks, and CTR.
PageSpeed Insights: Site Kit also integrates Google PageSpeed Insights into the WordPress dashboard to evaluate the speed and performance of the website. This allows website owners to identify and fix problems that
11.3. Google Web Fonts
We use so-called web fonts provided by Google on our website for the uniform display of fonts. When you visit one of our pages, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
The browser you are using connects to Google's servers. This allows Google to know that our website has been accessed via your IP address. If your browser does not support web fonts, a standard font from your computer will be used.

11.4. Google reCAPTCHA
We use Google reCAPTCHA on our website, a service provided by Google Ireland Ltd., Google Building Gordon House, Barrow St, Dublin 4, Ireland, headquartered at Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, both collectively referred to as “Google.”
Google reCAPTCHA is a verification service for websites to distinguish human users from bots. In particular, the following information may be collected: IP address, technical information such as browser, operating system, or screen resolution, interactions with the captcha
The IP address is anonymized by Google reCAPTCHA so that it can no longer be linked to a specific person. When a visitor visits our website for the first time, Google reCAPTCHA can generate an identifier to recognize the visitor when they visit the website again.
The IP address is processed to analyze the visitor's approximate location and to prevent any suspicious activity, namely to identify IP addresses associated with spam or other unwanted behavior. The technical information is processed so that the captcha can be adapted to the device or browser and to detect deviations from normal usage behavior. Interactions with the captcha are processed to record behavior patterns in order to distinguish human behavior from automated bots. The aim of Google reCAPTCHA is to protect input forms from bots and spam, while at the same time enabling reliable input from humans. The data collected is not used to identify you personally.
The transfer of data by us is governed by our statements on data transfer. As Google is a transnational company, your data may be transferred by Google throughout the world. In particular, it may be transferred to Google's headquarters in the USA. This is a country where legislation does not guarantee adequate data protection.
11.5. Social media plugins
On our website, we use social media plugins from social networks such as LinkedIn, YouTube, Facebook, and X. You can see these plugins (typically via corresponding icons). We have configured our website so that the social media plugins are disabled by default. If you activate (click on) a plugin, a connection to the servers of the provider of the respective plugin is established and the providers can see that you are on our website. The processing of your personal data is the responsibility of the providers; we do not receive any information about you from them.
11.6. Framing
We use so-called framing from networks such as YouTube on our website. Framing essentially means “embedding.” We embed videos, photos, text messages, etc. from these networks on our website. This allows you to view them directly on our website. However, the actual content still comes from the network platforms. If the content is deleted there, it will also disappear from our website. We use what is known as “extended data protection mode.” A cookie is only stored on your computer when you play the video. If you want to ensure that no data about you is stored by the companies, do not click on the embedded videos.
11.7. Social networks/platforms
We are present on social networks and other platforms operated by third parties and process data about you in this context.
We also receive data from you on our platforms. However, the platforms can also analyze your use themselves and use data for their own purposes. We currently use the platforms listed below and refer to the privacy policies of the respective platforms via the following links:

12. Duration of storage
We process and store your personal data for as long as is necessary or appropriate to fulfill our contractual and legal obligations or to comply with the relevant legal provisions, or for as long as it is necessary for the purposes for which it was collected. Where possible, we will anonymize or delete your personal data as soon as it is no longer needed, or at the latest after the expiry of the statutory retention period.
You can request the deletion of your personal data at any time by sending a request to the contact point specified in section 2. We will comply with your request unless we are obliged to retain the data for other reasons (e.g., statutory retention obligations).
13. Rights of the data subject
You have the right to obtain information from us at any time as to whether we are processing personal data about you. You also have the option of having your personal data corrected, blocked, or deleted by us. This does not apply to data that we need to process outstanding orders or to enforce existing rights and claims, or to data that we are required to retain by law. You can also object to the disclosure of certain personal data. In addition, you can request that we return the data you have provided to us.
You can revoke your consent to the use of your personal data at any time. However, your revocation is limited to the storage and use of personal data that we are not permitted to store or use without your consent on the basis of legal permissions. Your revocation also has no effect on previous processing operations that were carried out on the basis of your consent.
To assert your rights, please contact us in writing and provide proof of your identity (contact details under section 2). Unless your rights are restricted by legal regulations or overriding public or private interests, we will be happy to comply with your request. The Federal Data Protection and Information Commissioner (https://www.edoeb.admin.ch/edoeb/de/home.html) acts as the supervisory authority for data protection matters.
14. Liability for links
We have no influence whatsoever on the current and future design and content of the linked pages on our website. This statement applies to all links and references within our own website. The provider of the page to which reference is made is solely liable for illegal, incorrect, or incomplete content and in particular for damage resulting from the use or non-use of such information, not the person who merely refers to the respective publication via links. We exclude any liability to the extent permitted by law.
15. Data security / technical and organizational measures
We would like to point out that communication with us via the public, freely accessible Internet involves certain security risks over which we have no influence or control. Please contact us if you wish to communicate via a secure connection.
For security reasons, we use SSL or TLS encryption for our website and to protect the transmission of confidential content. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. When SSL or TLS encryption is activated, data that you transmit to us cannot be read by third parties.
We also use technical and organizational measures (TOMs) to protect your personal data. These measures are regularly reviewed and adapted.
16. Changes
We reserve the right to change this privacy policy at any time. The current version published on our website applies. The privacy policy does not establish any contractual or other formal legal relationship with or on behalf of any party.
